November 22, 2011 - Jamie Boock settled a products liability claim for $2,200,000.00. Jamie represented a man who was 20 years old when he lost the middle three fingers and half of his dominant hand in an industrial machinery accident at his workplace. Because of the injuries, he had to undergo extensive surgery and physical therapy, and he now requires the use of cosmetic and functional prosthetics. The client filed suit against the manufacturer of a component of the machinery and against two co-employees – his supervisor and an employee who had modified the machinery. The client made claims for past medical bills and lost wages but made no claim for loss of earning capacity. The client settled his claims against all defendants at mediation for a total of $2,200,000.00.

November 22, 2011 - Matthew Rossiter successfully defended a claim in which the plaintiff accused his clients of breaching their fiduciary duties as trustees of their father's trust. The plaintiff in this case was the surviving spouse of the father, and Matt obtained summary judgment dismissing plaintiff's claims on the basis that his clients did not owe any fiduciary duty to the plaintiff because she was not a beneficiary of the trust.

November 5, 2011 - Matt Rossiter was elected by his peers to a six year term on the 21st Circuit Judicial Commission. As one of five Commissioners, Matt will interview all applicants for Associate and Circuit Judge positions in the St. Louis County Circuit Court. The Commission selects a panel of three applicants for each judicial vacancy, and sends their names to Governor, who appoints one to serve as judge.

September 20, 2011 - Jamie L. Boock obtained a favorable published opinion from the Eastern District of the Missouri Court of Appeals in the case of Gibson v. City of St. Louis, 349 S.W.3d 460 (Mo. App. E.D. 2011). The trial court entered judgment in favor of Gibson, the driver in a one-car collision, against the City of St. Louis for its negligent maintenance of the roadway. Before trial, Gibson settled a medical malpractice claim arising out of the treatment of the injuries sustained in the collision. The City appealed the trial court’s denial of the City’s motion for a reduction of the judgment under RSMo. § 537.060 for settlement payments from the medical malpractice defendants.

The Court of Appeals affirmed the judgment of the trial court. In so holding, the Court ruled that the injuries caused by the conduct of the City and the medical malpractice defendants were not “the same injury” and thus reduction of the judgment under RSMo. § 537.060 was not appropriate.

July 14 & 15, 2011 - Matthew Rossiter attended a seminar entitled "Representing Estate and Trust Beneficiaries and Fiduciaries," sponsored by the American Legal Institute and the American Bar Association, in Chicago, Illinois.

April 14, 2011- Matthew Rossiter obtained a Counterclaim Settlement of $354,406.00. A Trust Company filed a declaratory judgment action seeking instructions as to the interpretation of language in two trust documents. Matthew Rossiter, representing trust beneficiaries, filed a counterclaim for breach of fiduciary duty. The claim was settled at mediation, with the beneficiaries receiving $354,406.00. The Trust Company waived its claim for fees.

February 16, 2011 - Matthew Rossiter moderated the Sixth Annual Fiduciary Litigation Seminar, and also presented the Annual Update on the Law. Over 100 attorneys were in attendance.

November 3, 2010 - Jamie Boock successfully obtained a verdict after a jury trial against the City of St. Louis for failing to timely repair a dangerous condition on a City of St. Louis road which resulted in a one-car accident.  Jamie's client was severely injured by the accident.  The jury awarded the plaintiff $106,000.00 and assessed 60% fault to the city.  The City of St. Louis made no offer to settle before trial.

October 12, 2010 - Rossiter & Boock settled an automobile collision case filed in St. Clair County, Illinois for $650,000.00.  The clients were two retirees injured when a driver pulled in front of them while traveling on U.S. Highway 50 outside of Lebanon, Illinois.  The clients made no claim for lost wages and their physical injuries had essentially resolved.

August 26, 2010 - Jamie Boock obtained a successful verdict after a jury trial in St. Louis County in a pedestrian/automobile collision case. The verdict was fifty percent higher than the insurance company’s last offer, even though liability and the extent of plaintiff’s injuries were heavily disputed.

August 5, 2010 - Matt Rossiter obtained a judgment of $86,000.00 for his client in St. Louis County Probate Court. Matt represented one sibling in a claim against the other sibling to challenge transfers of money and property out of their mother’s account before her death. Transfers were made under a durable power of attorney.

December 22, 2009 - The Supreme Court of Missouri issued a favorable opinion in the case of Moore v. Goffstein. In arguing this case before the Supreme Court, Jamie Boock successfully overturned existing appellate law on issues relating to objections to garnishment interrogatory answers.

December 8, 2009 - Jamie L. Boock was elected to the 2010 Executive Committee of the St. Louis County Bar Association.
